IHE Nonprofit Clarity Act
Summary
The IHE Nonprofit Clarity Act would align how the Department of Education and the Internal Revenue Service classify higher education institutions. Currently, an institution of higher education might be recognized as a tax-exempt nonprofit by the IRS under Section 501(c)(3) of the tax code, but not automatically recognized as a nonprofit institution by the Department of Education under the Higher Education Act. This bill would eliminate that potential mismatch by requiring the Department of Education to automatically recognize any institution as a nonprofit if the IRS has already granted it tax-exempt nonprofit status.
If enacted, this bill could simplify the regulatory process for colleges and universities by removing the need to seek separate nonprofit designations from multiple federal agencies. It would create consistency between tax and education law, potentially reducing administrative burden and confusion for institutions navigating federal requirements. The bill is currently in the House committee stage and has not yet been voted on by the full chamber.
