Summary
Sales Incentive Compensation Act - Amends the Fair Labor Standards Act of 1938 to exempt from minimum wage recordkeeping and overtime compensation requirements any employee in a sales position, if the employee has: (1) specialized or technical knowledge related to products or services being sold; (2) sales which are predominantly made to persons to whom any employee in the sales position has made previous sales, or without the employee's having initiated the sales contact; (3) a detailed understanding of customers' needs, and discretion in offering a variety of products and services; and (4) a certain minimum rate of base compensation, and certain levels of additional compensation based on sales attributable to the employee.
Makes this Act inapplicable to individuals employed as route sales drivers.
