Political BIAS Emails Act of 2023

The Political BIAS Emails Act of 2023 (H.R. 5495) would prohibit email service providers from using automated filtering algorithms to mark emails from political campaigns as spam if the user has already opted in to receive them. Under this bill, an email from a political campaign could only be moved to a spam folder if the individual user manually chooses to label it as such.

For citizens, the practical impact would be that political campaign communications would more consistently appear in their primary inboxes rather than being automatically filtered out by their email provider's security systems. Additionally, the bill requires large email providers to produce quarterly transparency reports detailing how many political emails were flagged as spam and to provide campaigns with information on how to better reach their supporters' inboxes.
