Student Aid Fraud Oversight and Accountability Act of 2026
Summary
H.R. 7891 would amend federal education law to strengthen oversight of student aid fraud. The bill would require the Secretary of Education to identify and prioritize program reviews of colleges and universities that disburse federal financial aid to students whose financial aid applications (FAFSA) show signs of potential identity fraud. These flagged institutions would be subject to audits, investigations, and other oversight activities. The bill would work in conjunction with a separate identity fraud detection system that the Education Department would use to screen FAFSA applications starting October 1, 2026.
If enacted, the bill could help prevent federal student aid dollars from reaching fraudulent applicants while ensuring legitimate students receive aid. However, some lawmakers have raised concerns that the oversight requirements could create administrative burdens on colleges and universities, and that students mistakenly flagged for fraud might face delays in receiving their aid. The bill passed committee on March 17, 2026 with unanimous support (33-0 vote) and is now eligible for a full House floor vote.
