Rail Passenger Fairness Act

The Rail Passenger Fairness Act would grant Amtrak the authority to sue freight railroad companies in federal court when they fail to give passenger trains preference on shared tracks. Under current law, only the Department of Justice can bring such legal actions, a power that has been exercised only once since 1973. By allowing Amtrak to enforce its own right-of-way, the bill aims to reduce delays caused by freight interference and improve on-time performance for passengers across the national rail network.
