NOTICE Act
Summary
The NOTICE Act (Notification of Troop Involvement and Congressional Engagement) would establish new requirements for presidential use of the National Guard within the United States. Specifically, the bill would require the President to notify Congress within 24 hours of any deployment of National Guard members for domestic law enforcement purposes and provide a clear justification for the deployment. If a deployment exceeds 48 hours, the President would be required to provide ongoing updates to Congress.
Currently, federal law does not require the President to notify Congress or provide justification when deploying the National Guard domestically, which supporters argue leaves this authority vulnerable to abuse. The bill aims to restore congressional oversight and ensure that such deployments are made transparently and within constitutional bounds. The legislation would apply to deployments made under federal law that allows the President to assume operational control of the National Guard in limited circumstances, such as to repel foreign invasion, suppress rebellion, or when regular forces cannot enforce federal law.
