Whistleblower Anti-Gag Act of 2026
Summary
S. 4099 would expand federal whistleblower protections to employees of government corporations such as the Federal Deposit Insurance Corporation and Tennessee Valley Authority. Currently, federal agencies must include notices in nondisclosure policies informing employees they retain the right to make whistleblower disclosures to Congress, inspectors general, or the Office of Special Counsel. However, this requirement does not apply to the 26 government corporations. The bill would close this gap by extending the same notification requirement to these entities.
If enacted, the bill would ensure that employees working for government corporations receive the same legal notice of their whistleblower rights as those in traditional federal agencies. This would allow more federal employees to report waste, fraud, and abuse without fear of retaliation through illegal gag orders. The bill is cosponsored by Senator Ron Wyden (D-Oregon) and is currently under consideration by the Senate Committee on Homeland Security and Governmental Affairs.
