PLCAA Federal Jurisdiction Act

S. 484 proposes to amend the Protection of Lawful Commerce in Arms Act (PLCAA), a 2005 law that shields gun manufacturers and dealers from liability when their legally sold products are later misused in crimes. The bill would create a mechanism allowing defendants in firearms-related civil lawsuits to remove cases from state court to federal court if they believe the lawsuit qualifies as a "qualified civil liability action" under existing PLCAA protections. Once in federal court, judges could review whether the lawsuit meets PLCAA standards and dismiss cases that do not comply.

Proponents argue this change would prevent what they characterize as frivolous lawsuits and "forum shopping" by plaintiffs who file cases in state courts they view as more favorable. They contend the bill would ensure faster case resolution and more consistent application of federal procedural rules. Critics of the broader PLCAA argue the law already provides extensive protections to the firearms industry that prevent injured parties from holding manufacturers accountable for dangerous products or irresponsible business practices. The bill is currently in its early stages and has not yet received committee action.
