Navajo Nation Rio San José Stream System Water Rights Settlement Act of 2025
Summary
This bill would recognize and settle long-standing water rights disputes involving the Navajo Nation in New Mexico. Specifically, it would ratify a water rights settlement agreement between the Navajo Nation, the state of New Mexico, and other parties regarding the Rio San José Stream System. By doing so, the bill would resolve competing claims to water resources in that area.
The bill would establish the Navajo Nation Rio San José Water Rights Settlement Trust Fund to provide financial resources for implementing the settlement agreement. It would also specify the exact water rights allocated to the Navajo Nation and outline what claims the tribe and federal government would waive or retain as part of the settlement. Additionally, the bill would expand service areas for the Navajo-Gallup Water Supply Project, potentially allowing the project to serve additional communities.
If enacted, this settlement would provide the Navajo Nation with confirmed water rights and dedicated funding, while resolving legal uncertainties around water allocation in the Rio San José system. The bill has advanced out of the Senate Committee on Indian Affairs and is moving toward further consideration.
