NO FAKES Act of 2025
Summary
The Nurture Originals, Foster Art, and Keep Entertainment Safe (NO FAKES) Act of 2025 aims to establish a nationwide legal framework to address the rise of non-consensual deepfakes. It proposes creating a federal intellectual property right that grants every person—from private citizens to famous artists—the exclusive power to authorize digital replicas of their own voice and visual likeness. This right would last for an individual's entire life and could be extended for up to 70 years after their death, allowing families or estates to manage the deceased person's digital legacy.
If enacted, the bill would allow individuals to sue those who knowingly produce or distribute unauthorized digital replicas for financial gain or other purposes. It also proposes a notice-and-takedown system for online platforms, similar to existing copyright laws, which would require websites to remove infringing content once notified to avoid legal liability. While the bill includes exceptions for news, documentaries, and parody to protect free speech, it seeks to replace the current patchwork of state laws with a single federal standard to better protect people from digital identity theft and AI-generated misinformation.
