Summary
The Informing Consumers about Smart Devices Act would require manufacturers of internet-connected devices equipped with cameras or microphones to disclose this information to consumers prior to purchase. This applies to smart appliances such as dishwashers, refrigerators, and dryers, as well as other internet-connected consumer products that contain these recording or imaging capabilities. The disclosure must be clear and conspicuous, and manufacturers may use visual representations to communicate this information.
The Federal Trade Commission (FTC) would be responsible for enforcing the law and would issue guidance to manufacturers within 180 days of enactment to help them comply with disclosure requirements. The guidance would include best practices for making disclosures clear, conspicuous, and age-appropriate. Manufacturers can request tailored guidance from the FTC on how to meet the requirements. Violations would be subject to penalties under the Federal Trade Commission Act.
The bill passed the House on April 29, 2025, with overwhelming bipartisan support and is now under consideration in the Senate. If enacted, the law would give consumers greater transparency about which smart devices in their homes contain cameras or microphones, allowing them to make more informed purchasing decisions about products that could potentially record audio or video.
