The Guidance Clarity Act of 2025 proposes to change how federal agencies issue informal instructions, such as policy letters, FAQs, and memorandums. Currently, agencies often use these "guidance documents" to explain how they interpret laws and regulations, but these documents sometimes create confusion about whether they are legally enforceable rules. This bill would require agencies to prominently display a specific "guidance clarity statement" on the first page of such documents.
The required statement would explicitly inform the public that the contents of the document do not have the force and effect of law and do not bind the public or the agency. Instead, the statement would clarify that the document is only intended to provide helpful information regarding existing legal requirements or agency policies. By making this distinction clear, the bill aims to prevent agencies from using informal guidance to bypass the formal rulemaking process required for legally binding regulations.
If enacted, this legislation would provide greater legal certainty for individuals and businesses by ensuring they can easily identify which agency communications are mandatory and which are merely advisory. The bill would also require the Office of Management and Budget to issue specific instructions to all federal agencies on how to implement these new transparency requirements within 90 days of the bill becoming law.
