Protecting Our Supreme Court Justices Act of 2025
Summary
S. 399, the Protecting Our Supreme Court Justices Act of 2025, would increase criminal penalties for a specific form of protest activity. Currently, federal law allows up to one year in prison for picketing or parading near a judge's residence or workplace with the intent to interfere with justice or influence the judge's decisions. This bill would increase that maximum sentence to five years.
If enacted, the bill would make it a more serious federal crime to engage in picketing or demonstrations outside judges' homes or offices when done with the intent to influence judicial decisions or obstruct the administration of justice. This would apply to judges at all levels, as well as jurors, witnesses, and court officers. The practical effect would be to impose harsher penalties on individuals convicted of this conduct, potentially deterring such protest activities outside judicial buildings and residences.
The bill is currently in the early stages of the legislative process, having been introduced in the Senate in February 2025 and referred to committee. It has not yet been voted on by the full Senate.
