Fairness in Fentanyl Sentencing Act of 2025
Summary
The Fairness in Fentanyl Sentencing Act of 2025 would significantly lower the drug quantity thresholds that trigger mandatory minimum prison sentences for fentanyl-related offenses. Currently, possessing or distributing 400 grams of fentanyl triggers a mandatory minimum sentence for high-level offenders; this bill would reduce that threshold to 20 grams. For low-level offenders, the threshold would drop from 40 grams to 2 grams. Similar reductions would apply to fentanyl analogues, with thresholds falling from 100 grams to 5 grams for high-level offenders and from 10 grams to 0.5 grams for low-level offenders.
The bill would also require the U.S. Postal Service to increase availability of chemical screening devices and dedicate more personnel to intercepting fentanyl and other unlawfully imported substances. If enacted, these changes could result in longer prison sentences for individuals convicted of fentanyl offenses at lower quantities than currently required, while potentially improving the government's ability to detect and stop fentanyl shipments entering the country. The bill is currently in the committee stage and has not yet been voted on by the full Senate.
