Korematsu-Takai Civil Liberties Protection Act of 2025
Summary
The Korematsu-Takai Civil Liberties Protection Act of 2025 would establish a federal prohibition on detaining or imprisoning any person based solely on their actual or perceived protected characteristics. Protected characteristics would include race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, and any additional characteristics the Department of Justice determines warrant protection.
If enacted, this bill would aim to prevent government detention policies that target individuals because of who they are rather than their actions. The legislation would apply a broad standard, protecting against detention based on any single protected characteristic as the sole reason for confinement. The Department of Justice would have authority to expand the list of protected characteristics beyond those explicitly named in the statute.
Currently, the bill has only been introduced in the Senate and has not advanced to committee review. Most introduced bills do not progress further in the legislative process, so passage would require significant congressional support.
