No Political Enemies Act
Summary
H.R. 7060, the No Political Enemies Act, would establish legal protections against what supporters describe as politically motivated government actions. If enacted, the bill would prohibit federal officials from initiating investigations, enforcement actions, or regulatory measures substantially motivated by individuals' or organizations' constitutionally protected speech or political participation.
The bill would create several legal mechanisms for those who believe they have been targeted. It would establish an affirmative defense in criminal and civil cases, allowing defendants to argue that government actions were politically motivated, after which the government would need to prove legitimate, non-political reasons for its actions. Individuals could file civil lawsuits seeking injunctions to stop such actions and monetary damages for violations of their First Amendment rights. If someone prevails in such a case, the government would be required to pay their attorney's fees and costs.
Additionally, the bill would prohibit the use of federal funds for politically motivated government actions and require the Attorney General to submit quarterly reports to Congress on significant investigations that could be viewed as politically motivated. The bill is currently in committee and has not yet been voted on by the full House.
