ICE Out of Our Faces Act
Summary
The ICE Out of Our Faces Act would prohibit Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP) officers from acquiring, accessing, or using facial recognition technology and other biometric surveillance systems. The bill would also require these agencies to delete all biometric information they have already collected within 30 days of the law's enactment.
The legislation would allow individuals and state attorneys general to pursue civil legal action against the federal government for violations, and would make evidence obtained through biometric surveillance inadmissible in court proceedings. Officers who violate the law could face retraining, suspension, termination, or other penalties.
Proponents argue that facial recognition technology is inaccurate and discriminatory, particularly against Black and brown communities, and that it enables surveillance without consent. The bill is currently under consideration by the House Judiciary Committee and the House Homeland Security Committee.
